Artistry Wellness Hawaii Membership Terms & Conditions

 

Redemption of Complimentary Services

As part of your Artistry Wellness Hawaii Membership your (1) complimentary monthly treatment may be redeemed in the month within (30) days  after you are charged your membership fees. Monthly complimentary services do not rollover.

 

Services & Additional/Excluded Services

Upon payment of the Membership Fee specified at checkout for the level of Membership an individual has selected, AWH will make available to such Member the opportunity to access the Services specified as being included at that level of Membership pursuant to the terms of these Terms and Conditions, the Membership Agreement.

Services not specified as being included at the level of Membership selected and paid for are not covered by the Membership Fee. If a Member requires healthcare or other services, procedures or products outside of those specified as being included at the level of Membership selected and paid for (“Additional Services”), such Member will be solely responsible for the cost of such healthcare or other services. AWH may refer a Member to another physician or other healthcare practitioner for Additional Services. Alternatively, AWH in its sole discretion may provide such Additional Services for an additional fee. A Member’s insurance, if any, may or may not cover the costs of Additional Services. Additional Services may include, without limitation, the following:

  • Emergency and specialist medical services.

  • Supplements purchased through AWH or other sources.

  • Healthcare services provided other than by AWH.

  • Non-medical services recommended by AWH.

  • Medications, whether prescribed or over-the-counter.

 

Freezing a Membership

There may be times when a member will need to freeze his/her membership for a short period of time, due to circumstantial reasons such as military leave, pregnancy, extended illness, relocation, etc. When a membership is frozen, the member is not authorized to use his/her membership services or benefits during the freeze period. You must be a member for at least 30 days and have made at least one month’s membership payment in order to be eligible to freeze your account. Memberships may be frozen once during a 12-month period, for a minimum of 30 days and a maximum of 3 months, depending on the circumstantial reason that will be determined by AWH. The member may designate a date to end their freeze period at any time. If no end date is given, the membership will be frozen for the full 3 month freezing period. At the end of the membership freeze term, your dues will continue with your next scheduled monthly payment date. The terms and conditions will continue to apply through the extended membership term. To initiate a freeze, submit a written request to AWH.

 

Privacy Statement

Artistry Wellness Hawaii (AWH) collects and uses your personal information to operate our electronic medical record and POS system and deliver the services you have requested. AWH also uses your personally identifiable information to inform you of other products or services available from AWH and its affiliates. AWH may also contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered.

 

AWH does not sell, rent or lease its customer lists to third parties. AWH may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. In those cases, your unique personally identifiable information (e-mail, name, address, telephone number) is not transferred to the third party. AWH does not use or disclose sensitive personal information, such as race, religion, or political affiliations, without your explicit consent. AWH will disclose your personal information, without notice, only if required to do so by law.

 

Your credit card and email address is required for AWH’s membership. You credit card will remain securely and encrypted on file with our POS merchant vendor. AWH does not keep your full credit card account number on file with the exception of the last 4 digits of your credit card number.

 

Not Insurance

Each Member acknowledges and agrees that Membership and these Terms and Conditions do not constitute an insurance plan or a contract for health insurance, and are not a substitute for health insurance or other health plan coverage. The Services provided by AWH are intended to be services that are not covered by or reimbursable under any private health insurance policy, private health plan, or government program (including, but not limited to, Medicare/Medicaid) in which a Member participates.

Each Member acknowledges and agrees that Membership establishes a direct contractual relationship for the performance of services between such Member and AWH, as the service provider, governed by these Terms and Conditions. A Member’s Membership is not subject to the guidelines, restrictions, or policies established by health insurance companies, health maintenance organizations, hospital service organizations, or Medicare/Medicaid. Each Member further acknowledges and agrees that AWH will not fulfill an insurance company’s or HMO’s requirement for an in-network primary care physician.

Refunds & Termination

Membership fees are non-refundable. Once checkout or renewal is complete a Member may not change the Membership level without the prior consent of AWH which may be granted or withheld at AWH’s discretion. A 30 day written notice before your next scheduled payment is required to cancel a monthly membership plan.

AWH may terminate a Member’s Membership, at any time, upon:

  1. such Member’s breach of these Terms and Conditions or any AWH policy or procedure;

  2. such Member’s non-payment of fees when due or having an outstanding balance of $100 or greater if not paid within thirty (30) days after written request to do so; or

  3. such Member’s harassment, threatening behavior, or any other action by such Member which in AWH’s reasonable discretion places AWH personnel at risk of harm.
